TERMS AND CONDITIONS

Acceptance of terms and conditions: By completing the online process to enter an event in the Gallagher Insurance Challenge Wānaka Festival (the Event), which is organised by The Challenge Wānaka Sports Trust (the Organiser), you accept the following terms and conditions.

TERMS & CONDITIONS OF ENTRY

Age Restrictions
  • On the date of the Event you must be 18 or older, unless you are a Secondary School Team athlete, in which case you must be 16 or older (unless otherwise pre-approved by the Event Director).
  • If you are under the age of 18, your parent or legal guardian must complete the online entry process on your behalf and must accept full responsibility for your compliance with these terms and conditions.
Acknowledgement of Risk

By entering the Event you acknowledge that: 

  • competing involves risks which include: 
    • using open water (lake), 
    • public areas and roads used by other people and traffic, 
    • running on rough terrain;
  • the Organiser has done its best to make the Event as safe as possible taking into account that the Organiser cannot control every eventuality; 
  • you participate at your own risk, knowing that participating in the Event can cause injury, damage to equipment or death;
  • your failure to comply with the Race Manual, Race Briefing or officials’ instructions may result in you being removed from the Event and disqualified;
  • your entry fee is non-refundable if:
    • the Event is cancelled or stopped for any reason, or 
    • you become pregnant, or
    • other personal circumstances prevent you from participating in or completing the Event;
  • you are aware of the option of purchasing ‘ACTIVE Refund’ registration refund protection during registration (see further info on this page: refund policy and information)
  • the Organiser is not liable for anything resulting from your entry or participation in the Event.
Your Responsibilities as a participant

You confirm that: 

  • you are physically fit and have trained sufficiently for the Event;
  • you have not been advised by a qualified medical person that you are not able to participate;
  • you have familiarised yourself with the course prior to the Event;
  • you have read and understood the Event Race Manual and Race Briefing and acknowledge that they are clear and unambiguous;
  • you will attend the race briefing prior to the Event;
  • you will follow the course set out for the Event and instructions given by Event officials;
  • you will respect all other participants, officials, volunteers and spectators.
Event Tracking

You must wear the race number and transponder as directed by the Event officials.

You acknowledge that:

  • if the transponder fails, you may not receive a time record and will have no claim against the Organiser or be entitled to a refund of your entry fee;
  • you must pay$150 for any transponder that is not returned to the correct Event official.
RaceRanger

You agree to use RaceRanger drafting technology:

  • the RaceRanger device will automatically transmit your bike’s location while attached to the bike.
  • if either the transponder or the RaceRanger device fails, you may not receive a time record and will have no claim against the Organiser or be entitled to a refund of your entry fee;
  • you will be charged $250 for the transponder or RaceRanger devices if not returned promptly to the correct Event official or RaceRanger Staff following the completion of the event.
Medical Treatment

Any medical conditions disclosed at time of entry will be shared with the event medical team prior to the event.

If you suffer an injury, accident or illness during the Event, you:

  • consent to receive medical treatment;
  • will allow information regarding your medical treatment to be given to the Organiser and others involved in organising the Event;
  • will pay all costs associated with your medical care and transportation;
  • will provide a name and contact phone number of a person who is not competing in case of emergency and ensure that person is available during and after the Event.
Use of your image and information

You allow the use of your name, voice and image to be used in the media and for marketing purposes and for the purpose of recording your race result, promoting future or other events and promoting the Event charity, race sponsors, products and services. You allow your information to be added to the Organiser’s database and being automatically subscribed to various emails and publications. You can, however, opt out of receiving these communications.

Prizes and other benefits

The Organiser has absolute discretion in awarding prizes, prize money or third party prizes or awards. The Organiser may provide gifts or other benefits as part of your entry but cannot guarantee their availability. No gift or benefit is transferrable or able to be exchanged or cashed in.

Complaints

If you have a complaint concerning the Event or these terms and condition, you:

  • will first raise the complaint with the Organiser with the objective of reaching an acceptable agreement within 14 days;
  • will not discuss the complaint with anyone else, recognising that you could otherwise jeopardise the future of the Event;
  • If agreement cannot be reached within 14 days, agree that the matter will be referred to mediation.
Other

The Event is based on the competition regulations of World Triathlon and Triathlon NZ (the national triathlon association), including its procedural and disciplinary codes. By entering the Event, participants accept that these regulations and codes are binding.

Changes to terms and conditions

The Organiser may revise these terms and conditions by updating its website and may change the content, links or functionality of the website at any time. Your participation in the Event will constitute your acceptance of the revised terms and conditions. New Zealand law applies to the Event and these terms and conditions.

  • you participate at your own risk, knowing that participating in the Event can cause injury, damage to equipment or death;
  • your failure to comply with the Race Manual, Race Briefing or officials’ instructions may result in you being removed from the Event and disqualified;
  • your entry fee is non-refundable if:

    • personal circumstances prevent you from participating in or completing the Event;

  • you will attend the race briefing prior to the Event.
  • you will follow the course set out for the Event and instructions given by Event officials;
  • you will respect all other participants, officials, volunteers and spectators.
